These Terms of Service (the "Terms") are a legal agreement between you and Backlund Plumbing, Inc., a Pennsylvania corporation ("Backlund Plumbing, Heating, & Cooling," "we," "us," or "our"). They govern your use of our website, your communications with us (including SMS / text messages), and the residential and commercial plumbing and HVAC services we provide.
By using our website, submitting a form, requesting a quote, opting in to receive text messages, or engaging us for services, you confirm that you have read, understood, and agree to these Terms. If you do not agree, please do not use our website or services.
1. Who May Use Our Services
You must be at least 18 years old and able to enter into a legally binding contract to use our website and services. By using our website, you represent that you meet this requirement. If you are submitting a request on behalf of someone else (for example, a family member, property owner, or property manager acting on behalf of a client), you confirm you have authority to do so.
2. Our Services
Backlund Plumbing, Inc. provides residential and commercial plumbing and HVAC services in Bucks and Montgomery counties, Pennsylvania, including (without limitation) heating and cooling service and replacement, plumbing repairs and renovations, well tanks and pumps, drain cleaning, water heater service and replacement, and 24-hour emergency service. Specific scope, pricing, equipment, and timing for each engagement will be confirmed in a written estimate, quote, or work order.
2.1 Estimates and pricing
Quotes are estimates based on the information you provide and our remote or on-site assessment. Final pricing may be adjusted if the actual conditions of the property differ materially from what was described — for example, undisclosed plumbing or system conditions, additional work needed once a fixture or unit is opened up, or unsafe access. Any adjustment will be discussed with you and agreed in writing before the additional work proceeds.
2.2 Scheduling and access
You agree to provide reasonable and safe access to the property, including water and electrical shutoffs where required, on the scheduled service date. If you need to reschedule, please give us at least 24 hours' notice when possible. We may charge a reasonable trip fee for missed appointments or last-minute cancellations.
2.3 Property condition
You agree to disclose, in advance, any known conditions that could affect the service, including but not limited to: knob-and-tube or otherwise non-standard wiring, lead paint, asbestos, structural issues, prior unpermitted work, active leaks, prior chemical treatments to drains or pipes, or sensitive landscaping near excavation areas. We are not responsible for damage or delay that results from undisclosed pre-existing conditions or from work performed by others.
2.4 Satisfaction and warranties
If you are not satisfied with the result of a service, please tell us before our crew leaves the property — or within 24 hours of completion — and we will return promptly to address reasonable concerns. Equipment we install (such as water heaters, furnaces, boilers, and air-conditioning units) is covered by the warranties offered by its manufacturer, and we will pass through and help administer any valid warranty claim on equipment we supplied. Our workmanship is warranted as stated in your specific written estimate or work order. This commitment does not create any warranty beyond what is required by applicable law.
3. Payment
Unless otherwise agreed in writing, payment is due upon completion of service. For larger installation or renovation projects, payment terms — including any deposit, progress payments, and final payment due upon substantial completion — will be set out in your written estimate or work order. We accept the payment methods listed in your invoice. Past-due balances may accrue interest at the maximum rate permitted by Pennsylvania law and may be subject to reasonable collection costs.
4. SMS / Text Messaging Terms
If you provide your mobile phone number and check one or both of the optional consent boxes on our forms (or otherwise expressly opt in), you agree to receive text messages from Backlund Plumbing, Inc. at the number you provided, sent on our behalf using an automated system. You are not required to opt in as a condition of purchasing any service from us.
4.1 Program description
- Transactional SMS (separate opt-in): appointment confirmations, scheduling and rescheduling updates, on-the-way notifications, service status updates, completion confirmations, invoices, payment receipts, and other communications related to a service you have requested.
- Marketing SMS (separate opt-in): seasonal maintenance reminders, promotional offers, service reminders, and announcements about new services from Backlund Plumbing, Inc.
Message frequency: varies based on your interactions with us — typically a small number of messages per month for transactional updates, and occasional messages for marketing.
Message and data rates may apply based on your wireless plan and carrier. We do not charge for the messages themselves, but your carrier may.
To get help: reply HELP to any message from us, or contact us at [email protected] / (215) 337-2467.
To opt out: reply STOP to any message from us at any time. You will receive a one-time confirmation that you have been unsubscribed. After that, you will not receive further SMS messages from the relevant program unless you opt back in.
Privacy: mobile information and SMS opt-in consent will not be sold, rented, leased, or shared with any third parties or affiliates for marketing or promotional purposes. The only entities that receive your mobile information for the SMS program are our SMS-platform and carrier service providers, who use it solely to deliver messages you have requested. See our Privacy Policy for full details.
Carriers, including but not limited to AT&T, T-Mobile, Verizon, and their respective affiliates, are not liable for delayed or undelivered messages. We cannot guarantee delivery of any specific message.
5. Acceptable Use of Our Website
When you use our website, you agree not to:
- Submit false, misleading, or fraudulent information (including someone else's phone number without their permission)
- Use our website or messaging program to harass, abuse, or harm another person
- Interfere with or attempt to disrupt the security or operation of our website
- Use any automated system, bot, or scraper to access our website without our written permission
- Use our website in violation of any applicable law or regulation
6. Intellectual Property
The Backlund Plumbing, Heating, & Cooling name, logo, website content, copy, photos, and graphics are owned by Backlund Plumbing, Inc. or its licensors and are protected by copyright, trademark, and other intellectual-property laws. You may not copy, reproduce, distribute, or create derivative works from any of it without our prior written permission, except that you may share links to our website.
7. Third-Party Links and Services
Our website may include links to third-party websites or use third-party services (for example, Google Maps, Meta lead forms, review platforms, or payment processors). We are not responsible for the content, accuracy, or practices of any third party. Your use of any third-party service is governed by the third party's own terms and privacy policy.
8. Disclaimer of Warranties
Our website and services are provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties of any kind, whether express, implied, statutory, or otherwise, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that our website will be uninterrupted, error-free, or free of viruses or other harmful components, or that any defects will be corrected. Workmanship and equipment warranties applicable to any service or installation we perform are as expressly stated in your written estimate or work order; this Section does not limit those service-specific warranties.
9. Limitation of Liability
To the maximum extent permitted by law, Backlund Plumbing, Inc. and its officers, directors, employees, and contractors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages — including lost profits, lost data, or loss of goodwill — arising out of or related to your use of our website, services, or SMS program, even if we have been advised of the possibility of such damages.
Our total cumulative liability for any claim arising out of or related to these Terms, our website, or any service you have purchased will not exceed the amount you have paid us for the service giving rise to the claim in the twelve (12) months before the claim arose. Some jurisdictions do not allow the limitation or exclusion of certain damages, so some of these limitations may not apply to you.
10. Indemnification
You agree to defend, indemnify, and hold harmless Backlund Plumbing, Inc. and its officers, directors, employees, and contractors from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your violation of these Terms; (b) your misuse of our website or services; (c) your violation of any law or the rights of any third party; or (d) any false or unauthorized information you provide to us (including phone numbers you do not have permission to provide).
11. Termination
We may suspend or terminate your access to our website or services at any time, with or without notice, if we believe you have violated these Terms or applicable law, or if continuing to provide service would expose us to legal or financial risk. You may stop using our website at any time. The provisions of these Terms that by their nature should survive termination (including Sections 6 through 13) will survive.
12. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. If we make material changes, we will provide additional notice (for example, by posting a notice on our website or sending you an email). Your continued use of our website or services after the update means you accept the revised Terms.
13. Governing Law and Disputes
These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-laws principles. You and Backlund Plumbing, Inc. agree that any dispute arising out of or related to these Terms or our services will be brought exclusively in the state or federal courts located in Bucks County, Pennsylvania, and you consent to the personal jurisdiction of those courts. Nothing in this section limits any rights you may have under applicable consumer-protection law.
14. Miscellaneous
These Terms, together with our Privacy Policy and any written estimate, work order, or invoice between us, form the entire agreement between you and Backlund Plumbing, Inc. about your use of our website and services. If there is a conflict between these Terms and a signed written estimate or work order, the signed estimate or work order controls as to that service. If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any provision is not a waiver of our right to enforce it later. You may not assign these Terms without our prior written consent; we may assign these Terms in connection with a merger, acquisition, or sale of assets.
